Use of NZQA's publications and copyright material on NZQA's websites
The copyright in NZQA publications and in all materials contained or available on NZQA's websites (together referred to as "NZQA material"), unless otherwise stated, belongs to NZQA and is subject to the copyright laws of New Zealand.
Non-commercial educational use of NZQA material within New Zealand is permitted subject to the General Conditions and Specific Conditions set out below. For use overseas see the section below "Use of NZQA material outside New Zealand".
All other uses of NZQA material require specific permission from NZQA - the person proposing to use the material should contact the relevant area of NZQA identified in this web page, or contact the Manager at the address provided at the foot of this page.
One part of the NZQA website holds National Qualifications Framework (NQF) material that includes the following:
- unit standards and achievement standards
- national qualification documents
- NQF assessment materials
- Accreditation Moderation and Action Plans (AMAPs)
- National Certificate of Educational Achievement and Scholarship examination material.
Some NQF resources have been developed by third parties. Copyright in all instances resides with NZQA but NZQA may consult any third party in relation to requests for reproducing material in which that third party may have an interest.
For NCEA and Scholarship examination material that incorporates third-party copyright content, unless permission of the third party has been given or unless an exception in the Copyright Act applies to the affected content, NZQA will provide the examination material with the third-party copyright content removed (where possible a reference to the source will be given).
New Zealand secondary schools have access to NCEA and Scholarship examination material through the secure schools' website maintained by NZQA, in accordance with section 44A of the Copyright Act 1994.
General Conditions on non-commercial educational uses of NZQA material within New Zealand
- An "educational use" is a use that is only for an organisation's internal purposes by its staff and learners (for example assessing learners, preparing programmes of activities, or as reference materials for teachers).
- The educational use must not include any commercial use of the material.
- All NZQA material, including any part thereof, must always carry the NZQA Copyright Notice, as it appears at the bottom of each NZQA web page.
- Learners may retain any copies given to them as handouts for activities or assessments, for their own research and private study purposes
Specific Conditions on non-commercial educational uses of NZQA material within New Zealand
Organisations using NZQA material, but which have not been accredited to assess against standards on the NQF, must inform their learners that because the organisation is not accredited to assess against standards on the NQF, none of the training or teaching will lead to registration of learner credits or the award of an NQF qualification.
NOTE: Organisations that wish to gain accreditation to assess against NQF standards should contact the Quality Assurance Division business unit.
Commercial uses of NZQA material
Any person or organisation proposing to use NZQA material for a commercial purpose must apply to NZQA for permission for that use.
Without limiting the kinds of commercial use for which permission is necessary, a commercial use includes the use of NZQA material, including any part thereof,
- in any work or publication, or in any distribution or adaptation, that is not for the internal purposes of the person or organisation by its staff and learners, or
- in any renting out, selling or lending or material.
In making a decision NZQA may consult relevant stakeholders and identify an appropriate fee.
Specific requirements for commercial use of NCEA or Scholarship material (including examination papers)
Applicants wanting to commercially use NCEA or Scholarship material (including examination papers) in their publications must contact Secondary Examinations.
Applicants should complete the application form. The completed application form should be lodged with the Team Leader Editors, Secondary Examinations, together with supporting information showing how the material, in whole or part, will be used. Use of NZQA material outside New Zealand
Any New Zealand or international educational institution wishing to use NZQA material outside New Zealand must contact the International Liaison team to gain permission.
Use of Trademarks
Reproduction of NZQA logo
The New Zealand Qualifications Authority logo and the Kiwiquals logo, including their key elements, are registered trademarks, and use of them without NZQA permission will infringe New Zealand trademark laws.
Uses of the logos are restricted. Guidelines for appropriate use are available from Communications.
The following are uses of NZQA logos for which permission can be gained:
National Certificates
Organisations that have been granted permission by NZQA to issue National Certificates or National Diplomas may use the NZQA logo on those certificates. For more information contact the Tertiary Records team.
Government agencies
Government agencies may use the NZQA logo only if NZQA has granted approval in writing. If NZQA has agreed to the use of its logo, a member of NZQA's Communications team will supply the logo. For more information contact Communications.
Internet sites wishing to link to NZQA websites
Internet sites may link to NZQA websites or material on it, and use the NZQA logo in doing so. However, only the following statement about NZQA may be made when referring to NZQA:
"NZQA's purpose is to ensure that New Zealand's qualifications are accepted as credible and robust, both nationally and internationally.
"The overall role of the New Zealand Qualifications Authority is to be the independent and impartial expert organisation which can be relied upon to administer robust National Qualifications Framework assessment systems, and provide reliable quality assurance systems, that deliver on its statutory accountabilities."
NZQA Registered and Accredited Providers
NZQA registration and accreditation (of private education providers, for example) does not entitle an organisation to use the NZQA logo in any context.
A registered private training establishment may make the following statement on certificates, in publications and in publicity material, in relation to its status:
"A private training establishment that has been granted registration by the New Zealand Qualifications Authority under Part 18 of the Education Act 1989."
and/or
"He mea rehita na te Mana Tohu Mātauranga o Aotearoa kia tu hei Whai Whakangungu Motuhake i raro i te maru [Part 18] o te Ture Mātauranga 1989."
